General Terms and Conditions

Introduction

These General Terms and Conditions (hereinafter: “GTC”) set out the description of and the conditions for using the online services available on the website https://www.vizionaqua.com/hu operated by Creatiger Kft. (registered office: 2360 Gyál, Vállalkozó utca 2., company registration number: 13-09-155608, tax number: 23892842-2-13; hereinafter: the “Company” or “Service Provider”) (hereinafter: the “Service”).


II. Amendment of the GTC, Entry into Force and Acceptance by the User

The operator of the website https://www.vizionaqua.com/hu, i.e. the Service Provider, reserves the right to unilaterally amend these General Terms and Conditions. Information about the fact of the amendment and the provisions affected shall be made available to the User by clicking on the currently effective GTC.

The Service Provider shall publish the planned amendments on the homepage of https://www.vizionaqua.com/hu in a clearly visible manner for everyone at least 14 days prior to their entry into force.

The Service Provider shall notify its registered customers about amendments to the GTC by email sent to the registered email address at least 14 days before the amendment enters into force, indicating the provisions affected by the amendment.

If the Service Provider has informed the User of the amendment to the GTC in accordance with this section and the User does not terminate their registration before the amendment enters into force, the Service Provider shall consider that the User has accepted the amendment to the GTC and recognizes all its provisions as binding.

The currently effective GTC are available and downloadable for all visitors and registered users via the GTC tab on the website and also form an attachment to the electronic confirmation email of any order placed.

Pursuant to Section 6:82 of the Hungarian Civil Code, this contract qualifies as an electronic contract and is not filed by the Service Provider.

The contract shall be concluded between the Parties in the Hungarian language.


III. Registration, Modification, Suspension, Deletion, Automatic Confirmation

Natural person Users may, at their discretion, select products and compile a shopping list either following prior registration or without registration, while legal entities are entitled to do so exclusively after registration.

During registration, the User is obliged to provide accurate and truthful data. If any change occurs in the User’s data, the User must immediately notify the Service Provider via the telephone customer service or by email. The User may also request the deletion of their registration in the same manner.

The Company shall not be liable for any failure of the Service or any damage arising from the provision of incorrect data or failure to provide notification as described above.

If a natural person User selects products, compiles a shopping list, and places an order without prior registration, the Company will process the order; however, the User will not have access to the data of previous orders on the website https://www.vizionaqua.com/hu.

Each User may register only one user account per phone number and email address.

The Company is entitled to immediately delete the User’s registration (and thus their user account) if there is reason to believe that the User has violated the GTC.

The Company shall send a confirmation to the User within a maximum of 72 hours after the shopping list is compiled, containing the names of the selected products, their prices valid at the time of selection, and the service fee.


IV. Ordering Process

Prices, Quantity Deviations, Costs

Prices:

The prices displayed on the website are valid delivery prices, meaning that the prices valid at the time of delivery may not differ from those shown on https://www.vizionaqua.com/hu at the time of selection. Prices are indicated in Hungarian Forints (HUF) and include VAT but do not include delivery fees.

Costs:

If the User ultimately does not accept any of the selected products, the Company shall still charge a service fee for delivery, as the Service is subject to a fee. The User shall pay the service fee at the same time as the purchase price of the products actually accepted.

The delivery fee is HUF 2,900 in all zones.


Compilation of the Shopping List, Product Availability

The shopping list means selecting products available on the website https://www.vizionaqua.com/hu. Compiling a shopping list is not equivalent to placing an order and does not create an obligation on the User’s part to purchase the products.


Payment

The following payment methods are available on https://www.vizionaqua.com/hu:

– Payment by bank card via Barion

Online card payments are processed through the Barion system. Card data are not transmitted to the merchant. Barion Payment Zrt. is an institution supervised by the Hungarian National Bank, license number: H-EN-I-1064/2013.

– Bank transfer

In the case of payment by bank transfer, the payment deadline is 5 business days. Orders will only be processed after the transfer has been received. If the payment does not arrive in the Company’s bank account by the deadline, the order will be automatically cancelled.

Please indicate the order number in the transfer reference.

If the User cancels the request in accordance with the GTC or does not accept the delivered products, the Company shall in all cases be entitled to charge the delivery fee (even if the free delivery threshold has been reached).

Invoicing

After payment, the consumer shall always receive an invoice, either sent electronically to the email address provided and/or in printed form at the time of delivery of the products.

Electronic invoices must be printed by the User from the received email. The remotely issued invoice qualifies as a paper-based invoice and is not an electronic invoice; therefore, it cannot be stored exclusively electronically.

Due to email service provider settings, the invoice email may end up in the “Spam” folder; therefore, if the invoice is not received, Users are advised to check their spam folder.

For company invoicing, the “COMPANY INVOICING” option must be selected at checkout, and the company name, address, and tax number must be provided, based on which the system will automatically issue a VAT invoice.

The relevant checkbox must be selected at each checkout to ensure that company data are included on the invoice. Otherwise, the invoice will be issued to the original name and address recorded in the user account and cannot be modified retroactively.


V. Security

During registration, the User must create a password for their account. The User must keep this password confidential and may not disclose it to unauthorized third parties. The User bears full responsibility for all transactions carried out from their account.

The User must immediately notify the Company if they suspect that their password has been misused or accessed by a third party. In such cases, the Company is entitled to block the User’s account and request a password change.

The Company shall not be liable for any damage resulting from the User’s disclosure or misuse of their password, whether by the User or a third party.


VI. Intellectual Property, Website Use and Operation

The owner and operator of the website https://www.vizionaqua.com/hu is Creatiger Kft., which holds all rights (including copyright and other rights) to the website and its content.

Users must comply with applicable laws and the provisions of the GTC and may not harm the reputation or rights of the Company or other Users.

Certain parts of the Website use cookies to identify Users. Users may disable cookies via browser settings; however, some services may not function properly without cookies. By using the Website, the User consents to the storage and use of cookies. Further information is available in the Privacy Policy.


VIII. Liability

Although the Company makes every effort to ensure the accuracy of the content on https://www.vizionaqua.com/hu, it cannot guarantee complete accuracy in all cases and assumes no liability for errors, interruptions, or technical difficulties.

The Company is not liable for third-party content, external websites accessed via links, advertisements displayed by third parties, unauthorized content, incompatibility with the User’s system, or technical malfunctions.

These provisions do not affect the Company’s statutory liability relating to information obligations, product liability, or warranty rights.


IX. Protection of Personal Data

Relevant GDPR provisions are available in the Privacy Policy.


X. Refusal to Accept Products, Withdrawal from the Contract (Returns)

A natural person User may withdraw from the contract within 14 calendar days of receiving the product(s) without providing a reason, except for products requiring refrigeration.

The Company shall refund the purchase price within 14 days of notification of withdrawal or allow the User to choose a replacement product.

The User is liable for any reduction in value resulting from use beyond what is necessary to determine the nature and functioning of the product.

Return shipping costs are borne by the User.


XI. Complaints, Warranty, Guarantee

Users may refuse defective products at delivery and may submit complaints within 72 hours through customer service.

Complaints are handled verbally or in writing, recorded, investigated, and responded to within 30 days.

Personal data related to complaints are stored for five years.

Users may initiate out-of-court dispute resolution through the competent Conciliation Board.

XII. Miscellaneous Provisions

Product information on the website serves for preliminary information only. Users must read product packaging instructions carefully.

Hungarian law shall govern the GTC. Images on the website are for illustrative purposes only.
