General Terms and Conditions
Effective from: April 26, 2026 until revoked
I. Introduction and Subject of the Contract
These General Terms and Conditions (hereinafter: “GTC”) govern the rights and obligations of Creatiger Kft. (registered office: 2360 Gyál, Vállalkozó utca 2., company registration number: 13-09-155608, tax number: 23892842-2-13; hereinafter: the “Service Provider”) and the business entities purchasing in the webshop (hereinafter: the “Customer” or “Buyer”).
Our Service Provider sells high-value agricultural sensors and electronic devices used for monitoring and automation of farms. The equipment is designed for professional use, contains sensitive electronics, and its procurement and delivery require significant time and cost investment.
This GTC is intended exclusively for legal entities acting in their own name, possessing a valid tax number, and acting within the scope of their profession, independent occupation, or business activity. By placing an order, the Customer declares and warrants that it does not qualify as a consumer, and that consumer rights (including in particular the 14-day right of withdrawal) do not apply to contracts concluded under this GTC. The Customer further declares that it purchases the products for its own business activity and not for private purposes. If the Customer purchases the product for non-business, consumer-type use, it is obliged to inform the Service Provider in writing in advance. In such cases, certain warranty and guarantee rights may apply based on applicable law.
II. Amendment of the GTC
The Service Provider reserves the right to unilaterally amend these GTC. Customers will be notified of amendments via a notice published in the webshop. Amendments become effective upon publication and do not affect orders already in progress.
III. Registration and Ordering
Registration: Purchasing in the webshop requires registration and the provision of a valid tax number. The Customer is obliged to provide accurate and up-to-date data. The Service Provider is entitled to reject or delete registration if the Customer does not meet B2B requirements.
Binding nature of offers: The product information displayed on the website does not constitute a contractual offer; it is for informational purposes only. Placing an order constitutes an offer by the Customer. The contract is concluded when the Service Provider confirms the order in writing (by email).
Prices and payment: Prices indicated on the website are in Hungarian Forints (HUF), are net prices, and do not include VAT or delivery costs. Considering the high value of the equipment, the Service Provider may require a minimum 30% advance payment or full prepayment; this will be communicated in the confirmation. Payment may be made by bank card (via the Barion system) or bank transfer. Settlement of the purchase price is a condition for the contract entering into force. The invoice will be sent electronically.
Delivery: The delivery fee and deadline are specified in the confirmation. The delivery of sensitive electronic equipment requires special packaging; the Service Provider bears the risk of damage until handover to the carrier. Risk and liability transfer to the Customer upon handover of the product to the carrier or the Customer. The Customer is obliged to inspect the product upon receipt and report any deficiencies or damage immediately, but no later than within 3 working days in writing; failure to do so shall be to the detriment of the Customer.
IV. Retention of Title
The delivered product remains the property of the Service Provider until the full purchase price has been paid. In the event of non-payment, the Service Provider is entitled to reclaim the product.
V. Warranty and Guarantee
Warranty (statutory warranty): The Service Provider provides warranty in accordance with Section 6:159 of the Hungarian Civil Code. The Customer is obliged to report any defect immediately after detection, but no later than within 8 days from delivery, in writing. The Service Provider shall not be liable for damages resulting from failure to meet this deadline.
Manufacturer’s guarantee: As our products are high-tech professional devices, the Service Provider’s guarantee obligation is limited to the guarantee provided by the manufacturer. Details of the guarantee are included in the warranty card or separate documentation provided with the product. From 2026, certain mandatory warranty rules applicable to durable consumer goods may also extend to micro and small enterprises under applicable law; the Customer must declare and prove eligibility for such provisions.
Limitation of liability: The Service Provider’s liability is limited to damages caused intentionally or by gross negligence, as well as damages affecting life, physical integrity, or health. The Service Provider shall not be liable for indirect damages or loss of profit, nor for damages arising in the Customer’s business activity due to product defects. The Service Provider’s total liability—except in cases of intentional damage—shall be limited to the net value of the ordered product.
Installation and operation: The Customer acknowledges that installation, commissioning, and calibration of the sold products are not part of the contract unless otherwise agreed in writing by the parties. The Service Provider shall not be liable for defects resulting from improper use or unprofessional installation.
VI. Exclusion of Withdrawal and Returns
The Customer acknowledges that the consumer right of withdrawal under Government Decree 45/2014 (II. 26.) does not apply to this B2B contract. After conclusion of the contract, the order cannot be cancelled and the product cannot be returned, except where the parties agree otherwise in writing or the product is proven to be defective. The Service Provider reserves the right to withdraw from or suspend performance of the order if the Customer fails to fulfill its payment obligations or commits another breach of contract.
VII. Copyright and Trademarks
The website and its content (including images, texts, graphics, and logos) are the intellectual property of the Service Provider or third parties. Unauthorized use is prohibited.
VIII. Data Protection
Personal data provided by the Customer during registration and contract performance are processed by the Service Provider in accordance with applicable data protection laws, in particular the GDPR. Details are set out in the Privacy Policy.
IX. Confidentiality
The parties mutually undertake not to disclose business secrets and information obtained during their cooperation to third parties, and to use such information solely for the performance of the contract.
X. Force Majeure
Events beyond the reasonable control of the Service Provider (including but not limited to war, natural disaster, epidemic, governmental measures, strike) shall be considered force majeure. The Service Provider shall not be liable for delays in delivery or failure to perform due to such events.
XI. Governing Law and Dispute Resolution
Matters not regulated in this GTC shall be governed by Hungarian law, in particular the provisions of the Civil Code. The parties shall attempt to settle disputes amicably. Failing this—due to the absence of consumer dispute resolution forums—the parties agree to the exclusive jurisdiction of the court competent at the registered office of the Service Provider.

These GTC enter into force on the date of publication on the website. By placing an order, the Customer declares that it has read, understood, and accepted these terms.
